Modernized hardware would be a clone. It's also not even original, this was a previously released hardware clone, now with a new logo. The money (so far) may be to secure the trademarks, but where will profits go after that's been paid? Will all profits be returned as a refund? I bet not. It's for profit, they even admit it.
